Eyepartner Granted Preliminary Injunction Against Kor Media Group for Copyright Infringement & Trade Secret Violations

Eyepartner (Plantiff) has won a preliminary injunction against Kor Media Group, LLC (KMG), Robert Korman, and Nic Mitchell (Defendants) for copyright infringement and trade secret violations related to the Defendants’ use of TikiLIVE v3.2, Eyepartner’s flagship HD broadcasting platform that provides users with a comprehensive set of tools for producing and managing live HD streaming content.

In April 2013, Eyepartner filed suit on the basis of the Defendants’ alleged infringement, circumvention, and trade secret misappropriation. According to the United States District Court Order, “the evidence indicates that Defendants copied significant portions of Plaintiff s copyrighted code and modified it to create their own competing software, and such modifications clearly constitute the making of a derivative work.”

The granted motion asked the court to enjoin the Defendants from “maintaining, using, distributing, marketing, disclosing, benefiting from, promoting, selling, offering for sale and licensing Eyepartner’s copyrighted TikiLIVE software platform, and engaging in acts of unfair competition based upon the Defendants’ rogue efforts to clandestinely decrypt Eyepartner’s confidential intellectual property and subsequent unlicensed use in direct competition.” After considering evidence and argument presented over seven days, the Court agreed and granted the motion.

On July 15, 2013, the Court ordered the Defendants to give up any and ALL computers and servers in order for a Forensic search of all code and trade secrets. Eyepartner estimates the intellectual property stolen along with trade secrets is valued at several million dollars. Once all discoveries have been conducted and the court is satisfied, a jury trial will decide the Federal Cyber Piracy case to be tried in Miami, Florida within a few months.
